By using colibri.build, you agree to these website terms and the privacy policy. If you do not agree, please do not use the site. This site is operated by Ian Bearss under the name Colibri in Colorado, United States.

Information, not a promise

The site describes past work and services that may be available. Content is for general information only. It is not legal, financial, tax, security, or other regulated professional advice, and it does not guarantee a particular result, schedule, price, availability, or outcome.

I try to keep the site accurate, but portfolio details, links, service descriptions, and availability may change. A proposal or signed agreement controls if it conflicts with this site.

Inquiries and client work

Sending a form or email does not create a client, consulting, fiduciary, or confidential relationship. A project begins only after both sides sign a separate agreement. Until then, do not send trade secrets, credentials, regulated data, or information you need kept confidential.

Project scope, fees, ownership, confidentiality, warranties, and support are handled in the written agreement for that project.

Original work and client materials

Unless stated otherwise, the original text, visual design, illustrations, and site code are owned by Ian Bearss or Colibri. You may view the site and share links to it, but you may not copy, republish, sell, or present original site materials as your own without written permission.

Third party libraries keep their own licenses. Client names, logos, screenshots, trademarks, and other project materials belong to their respective owners and are shown only to identify and discuss portfolio work. Their appearance does not transfer ownership or imply an endorsement beyond the work described.

Acceptable use

Do not misuse the site, interfere with its operation, submit unlawful or harmful material, probe for vulnerabilities without written authorization, overload the form, impersonate another person, or use automated systems to send spam. Ordinary indexing by search engines and answer engines is permitted under the site's robots.txt instructions.

External services and links

The site links to third party websites and uses third party hosting, form delivery, and email services. I do not control third party content, availability, security, or privacy practices. A link is provided for context and does not by itself mean endorsement. Your use of a third party service is governed by that provider's terms.

Availability and warranties

To the fullest extent permitted by law, the site is provided as available and without warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted availability, or freedom from errors or harmful components. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limits of liability

To the fullest extent permitted by law, Ian Bearss and Colibri will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, this public website. Total liability for a claim connected only to this website will not exceed the greater of 100 US dollars or the amount you paid to use the website, which is normally zero.

These limits do not apply where liability cannot lawfully be limited. They do not replace or change the liability terms in a signed client agreement.

Governing law

These website terms are governed by Colorado law, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be brought in a court with jurisdiction in Colorado, unless applicable consumer law requires otherwise.

Changes and contact

I may update these terms as the site changes. The effective date at the top identifies the current version. Continued use after an update means the new terms apply from their effective date.
